In July 2010 the Telecommunications Regulatory Commission, the sector regulatory Commission, ordered the operator Orange to undertake activities in order to ensure the opening of its fixed network to the other operators. The market analysis conducted by the Authority showed how Orange controls over 90 percent of the wholesale broadband market.

In order to improve the competitive market conditions, the Commission declared Orange an operator with significant market power, and imposed obligations with reference to the provision of fully unbundled services and shared access at local loop and sub-loop level, including the access to resources and services. Orange will also be required to offer a full range of wholesale broadband access, including naked DSL.

The incumbent will be required to submit a reference offer to the Commission and to comply with obligations of transparency, non-discrimination, accounting separation and cost-based prices. The Commission has also launched a public consultation on the fixed narrowband market analysis.
